BE IT ENACTED by the Emperor's most Excellent Imperial Majesty, by and with the advice and consent of the Members of Parliament assembled, and by the authority of the same, as follows:

Section I: Political Parties

Article I: Registration
A Citizen or Petitioner wishing to establish a political party may do so in the Ministry of the Interior.

Article II: Requirements
2.1 A Citizen or Petitioner wishing to establish a political party may obtain the license and the forum only after requirements have been fulfilled;

    [b] Manifesto/Founding Principles are drafted and presented in the Ministry of the Interior.
    [c] Logo and Structure of the Political Party is presented to the Ministry of the Interior.

2.2 Any Application that does not meet the full standards of this treaty will be voided.

Article III: License and Accommodation
An established Political Party may obtain its license only after the application is approved by the Ministry of the Interior, during which case the Ministry will create a separate forum with the proper forum appearance.

Article IV: Recognition
All Political Parties wishing to gain recognition must file the application and successfully complete it, and gaining the license given by the Ministry of the Interior.

Section II: Political Movements

Article V: Registration and Classification
5.1 A Citizen wishing to establish a Political Party, but does not meet the full requirements set by Article II of Section I may file a separate application to register a Political Movement.
5.2 A Political Movement shall be classified as any political organization whose membership is below 3 in total.

Article VI: License and Accommodation
An established Political Movement does not require a license due to its status as a Political Movement. The Political Movement shall not be accommodated with the Political Parties present.


Section III: Inactivity

Article VII: Inactivity
Any Political Party is classified as inactive if:
    [a] There is no active member present.
    [b] Has failed to answer any call sent out by the Ministry of the Interior.


Section IV: Enactment

Mssr. Speaker,

The bill is referred to as a treaty in certain parts of this draft. This should be amended quickly so as to allow us to get through this piece of legislation. Personally, I am abstaining from voting on this piece of legislation out of personal respect to the Right Honourable Member for Valeciennes. While I always respect his judgement, I am against imposing conditions on the establishment of political parties in this Empire and as such I cannot bring myself to support this bill.

I move to strike section 2.2 of this bill, and move to adopt the amended version offered by the Honorable Member from Valenciennes.

Mssr. Speaker,

There is nothing condescending in asking for my reasoning and I thank the Right Honourable Member for his concerns here. I oppose this bill because I oppose the restrictions on a person's right to create a political party. I believe that whoever wants to stand in election and create a banner behind which others can rally should have that choice instead of standing as an independent and then creating a party after he or she is in Parliament. I do not think it would be possible for my views on this to be accomodated, since it would entail the complete destruction of this bill's ethos. Therefore, that is why I am abstaining in this.

Furthermore, Mssr Speaker, I believe that the Right Honourable Member for Valeciennes is only supporting this bill because it reduces the work he has to do in opening up and creating new forums for political parties!! I also hope he understands that I am only joking and injecting some humour into proceedings with that.

Finally, Mssr. Speaker, I believe that the great mystery of the disappearing bills in the Hopper is that once a new bill is introduced, the bill at the bottom of the page disappears into nothingness. Is there some way you can rectify this, Mssr. Speaker, such as a second page for the hopper?

I would like to address the valid concerns that the Honorable MP from Ibelin has regarding this bill.

I understand where you’re coming from, sir. However, the point of this bill is to cut down on the unnecessarily huge amount of forums that is devoted to each party and to streamline the party creation process. Take for example the Union of Christian Nationalists. With all due respect, they’re a one-man show. I do not think a one-man show should be given a forum, it would be a waste of space. Now, if he were to recruit 2 more people to join, then he would be given a party forum and space would be adequately appropriated. This bill also provides measures to get rid of inactive parties as well.

Also, the provisions for a Political Movement enables people like, for example, the Union of Christian Nationalists, to send candidates to an election under their banner – they just wouldn’t have a forum for their party because it does not have 3 members yet.

I do not feel this bill undercuts any of the political rights of people, it just merely reigns over the plethora of tiny, tiny political parties that keep rising and demanding forum space. I believe that is what the bill is trying to achieve, not a curtailment of the people’s right to join a political party.

Franco, I believe that there are no provisions in the bill to affect existing parties, except for if they fall foul of Section III.

as the honorable member from valenciennes pointed out it existing ones are only affected by section III. motion to strike section 2.2 of the bill and replace with the amendment proposed by the honorable member of valenciennes is seconded.

I vote to defer and present the following alternatibe bill, which I believe is more coherent and complete without altering the basic principles of the original proposal:

© A copy of the founding principles of the political party as well as a charter or any document determining the way in which the political party will be organised internally.

2.2. Within fourteen (14) days of receival of the petition the Minister of Interior shall decide to accept registration of the political party and shall subsequently add the party’s name to the register of political parties, a register to be held in the Imperial Registry. The petitioner must personally be informed of this decision.

2.3 The Minister of Interior shall only accept registration of a political party if:
(a) the information under 2.1 of this article has been provided;
(B) the political party counts at least three (3) members at the date of the petition or afterwards, but at least at the time of the decision by the Minister;
© the name of the political party or its abbreviation does not contain any word or phrase, or any abbreviation or derivative thereof, the use of which is prohibited or restricted by any other law, unless in the latter case the restrictions have been complied with.

Article III: Setting up the forum of a political forum

3.1. Within 14days of acceptance of the registration, the Minister of the Interior shall set up a separate forum for the registered political party.
3.2. The registered political party having received a separate forum shall be bound by the laws and regulations with regard to the use of forums in the Empire of Alexandrians. The Minister of the Interior may determine a fee to be paid for the service provided.

Article IV: Legal personality and liability of registered political parties

4.1. Only a registered political party shall have legal personality and may in its own name appear in any court procedure, notwithstanding any other requirements imposed by the laws or rules on court procedures. A registered political party may not act under any name or abbreviation other  than that mentioned in the register of political parties.
4.2. The members of a registered political party shall not be held liable for the acts and omissions of that party, but a registered political party shall be held liable for the acts and omissions of a member which is mandated to represent that party.

Article V: Unregistering a political party

The registration of a political party shall be undone by the Minister of the Interior at the request of a member of the party, mandated to make such a request or at his own initiative, but in the latter case only if: 
(a) the political party procured its registration through fraudulent misrepresentation or concealment of a material fact;
(B) the political party appears to have no active member and has, within a period of 14days, not responded to any call sent out by the Minister of the Interior.

Article VI: Enactment
This act shall go into effect immediately after it has been given imperial assent.

c) the name of the political party or its abbreviation does not contain any word or phrase, or any abbreviation or derivative thereof, the use of which is prohibited or restricted by any other law, unless in the latter case the restrictions have been complied with.

Article III: Setting up the forum of a political forum

3.1. Within 14days of acceptance of the registration, the Minister of the Interior shall set up a separate forum for the registered political party.
3.2. The registered political party having received a separate forum shall be bound by the laws and regulations with regard to the use of forums in the Empire of Alexandrians. The Minister of the Interior may determine a fee to be paid for the service provided.

Article IV: Legal personality and liability of registered political parties

4.1. Only a registered political party shall have legal personality and may in its own name appear in any court procedure, notwithstanding any other requirements imposed by the laws or rules on court procedures. A registered political party may not act under any name or abbreviation other  than that mentioned in the register of political parties.
4.2. The members of a registered political party shall not be held liable for the acts and omissions of that party, but a registered political party shall be held liable for the acts and omissions of a member which is mandated to represent that party.

Article V: Unregistering a political party

The registration of a political party shall be undone by the Minister of the Interior at the request of a member of the party, mandated to make such a request or at his own initiative, but in the latter case only if: 
a) the political party procured its registration through fraudulent misrepresentation or concealment of a material fact;
B) the political party appears to have no active member and has, within a period of 14days, not responded to any call sent out by the Minister of the Interior.

Article VI: Enactment
This act shall go into effect immediately after it has been given imperial assent.
