| Section 1 1. This act may be cited as the Marriage Act, 2005. Section 2 1. The Emperor, the Prime Minister, the Minister of the Interior, and the clerics of any religious groups recognised as having a presence in Alexandria, have the competence to join two persons in matrimony if at least one of them is an Alexandrian citizen. 2. A couple that wants to marry can choose freely which functionary will join them in matrimony, but it is not allowed for anyone to join him or herself in matrimony with someone. Section 3 1. Both partners have to be at least 16 years old to marry. They bring each a best (wo)man who also is at least 16 years old. The best (wo)men don't have to be Alexandrian citizens. Section 4 1. The couple and the functionary set a date when the ceremony will be held. 2. Before the marriage the functionary has to check whether the partners aren't yet married to someone, in which case the marriage can't be held. 3. Persons with a common parent, grandparent, or great-grandparent, will not be allowed to marry. Section 5 1. The procedure of the ceremony performed by the state consists of the following: a. The functionary asks both if they both came to the marriage in free will and in full consent of their heart. b. The functionary asks the first partner: do you take x as your legal wife (or husband) and do you promise to be a loving and loyal husband (or wife) to her (or him) in good and bad days, in poverty as in wealth, in sickness and health till death do you part? c. The functionary asks the second partner: do you take y as your legal husband (or wife) and do you promise to be a loving and loyal wife (or husband) to him (or her) in good and bad days, in poverty as in wealth, in sickness and health till death do you part? d. The functionary declares: By the powers vested in me by the Empire of Alexandria I now pronounce you husband (or wife) and wife (or husband). From now on Alexandria will consider you married. 2. The procedure can be completed with texts chosen by the couple. These however have to be approved of by the functionary in advance. 3. The procedure for marriages performed by clerics varies by religion. 4. The language of the ceremony may be English, French or Spanish. Section 6 1. The Empire of the Alexandrians do not guarantee that a marriage conducted by one of its officials will be recognized on macronational level. 2. The Empire of the Alexandrians does recognize any marriage conducted on macronational level. Section 7 1. Divorce can be asked for in a marriage conducted by an official of Alexandria only if: a. The marriage hasn't been consumated one year after the ceremony. b. One of the partners is physically or psychologically maltreated by the other partner. c. Both parties agree to the divorce. 2. Applications for divorce have to be addressed to the Ministry of the Interior; the application will be examined and approved (or not) by the Minister of the Interior. Section 8 Should the parents so wish, all children from a marriage of one or two Alexandrian citizens will be accepted as Alexandrian citizens as soon as they are reported to the Minister of the Interior. Section 9 This act shall enter into effect on the day it is given Imperial Assent. |
