| His Imperial Highness, the Dauphin, introduces the following bill: National Security Act of 2005 Section 1 This Act shall be referred to as the National Security Act of 2005. Section 2 In enacting this legislation, it is the intent of the Estates-General to provide a comprehensive program for the future security of the Empire of the Alexandrians; to provide for the establishment of integrated policies and procedures for the departments, agencies, and functions of the Government relating to the national security; to provide a Ministry of Defense, including the three military Departments of the Army, the Navy, and the Air Force under the direction, authority, and control of the Minister of Defense; to provide that each military department shall function under the direction, authority, and control of the Minister of Defense; to provide for their unified direction under civilian control of the Minister of Defense; to provide for the establishment of unified or specified combatant commands, and a clear and direct line of command to such commands;; to provide for the unified strategic direction of the combatant forces, for their operation under unified command, and for their integration into an efficient team of land, naval, and air forces and to establish a single Chief of Staff over the armed forces and an overall armed forces general staff. Section 3 The Emperor of the Alexandrians is the Commander-in-Chief of the Armed Forces. Section 4 The Ministry of Defense shall coordinate and run the Armed Forces on a daily basis, but shall defer to the Emperor for all major decisions. Section 5 There shall be one officer of the military that will hold the rank of Marshal-General of the Grand Imperial Armed Forces and shall serve as Chief of Staff over all branches. His direct superior shall be the civilian Minister of Defense, and he shall follow all commands of the Emperor and the Minister of Defense. Section 6 Within the Executive Cabinet there shall be a National Security Council presided by the the Prime Minister. The function of the Council shall be to advice the Emperor with respect to the integration of domestic, foreign and military policies relating to national security as to enable the military services and other departments and agencies of the Government to cooperate more effectively in matters involving national security. In addition to performing such other functions as the Prime Minister may direct, for the purpose of more effectively coordinating the policies and functions of the departments and agencies of the Government relating to the national security, it shall, subject to the direction of the Prime Minister, be the duty of the Council to assess and appraise the objectives, commitments, and risks of Alexandria in relation to our actual and potential military power, in the interest of national security, for the purpose of making recommendations to the Emperor in connection therewith; and to consider policies on matters of common interest to the departments and agencies of the Government concerned with the national security, and to make recommendations to the Emperor in connection therewith. Section 7 The Prime Minister may appoint at his discretion a National Security Advisor to coordinate the functions of the Council and to advice the Prime Minister on national security matters. Section 8 There shall be a Director of Central Intelligence who shall be appointed by the Emperor, and shall serve as the head of the Alexandrian intelligence community; act as the principal adviser to the Emperor for intelligence matters related to the national security and serve as head of the Central Intelligence Agency. Section 9 There shall be a Central Intelligence Agency. The function of the Agency is to assist the Director of Central Intelligence in carrying out his responsibilities. The Central Intelligence Agency shall be under the jurisdiction of the Prime Minister. Section 10 There shall be a Special Intelligence Bureau for all internal security matters of the Empire. The Bureau shall be independent of the Central Intelligence Agency and is responsible only to the Emperor. Section 11 The Emperor in every possible instance shall consult with the Estates-General before introducing the Grand Imperial Armed Forces into hostilities or into situation where imminent involvement in hostilities is clearly indicated by the circumstances, and after every such introduction shall consult regularly with the Estates-General until Alexandrian Armed Forces are no longer engaged in hostilities or have been removed from such situations Section 12 Within sixty calendar days after a report is submitted to the Estates-General when the Emperor has deployed the Armed Forces whichever is earlier, the Emperor shall terminate any use of Armed Forces with respect to which such report was submitted, unless the Estates-General (1) has declared war or has enacted a specific authorization for such use of Armed Forces, (2) has extended by law such sixty-day period, or (3) is physically unable to meet as a result of an armed attack upon Alexandria. Such sixty-day period shall be extended for not more than an additional thirty days if the Emperor determines and certifies to the Estates-General in writing that unavoidable military necessity respecting the safety of Armed Forces requires the continued use of such armed forces in the course of bringing about a prompt removal of such forces. Section 13 All citizens of the Empire shall be members of the Gendarmerie, which may be called into action by the Emperor. Section 14 This Act shall go into effect once it has received Imperial Assent. |
