| Imperial Criminal Code Part I: Crimes Chapter 1: Crimes against this Empire of the Alexandrians Article 1: Treason A person who, being a Citizen of Alexandria: a. does anything tending to the death or destruction of His Imperial Majesty; b. levies war, or does any act preparatory to levy war, against His Imperial Majesty or this Empire of the Alexandrians; c. assists by any means whatever, with intent to assist, an enemy at war with this Empire of the Alexandrians, whether or not the state of public emergency has been declared; d. assists to another person who is, to his knowledge, guilty of treason in order to enable him to escape punishment; or e. knowing that a person intends to commit treason, does not give information thereof to a Law Court of Alexandria or to the corresponding authorities. shall be guilty of a crime, called treason, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than fifteen years. Article 2: Treachery Any person who shall do any act or thing to overthrow the High Laws of the Empire of the Alexandrians by revolution or sabotage or to overthrow by force or violence the duly established government of the Empire of the Alexandrians, shall be guilty of a crime, called treachery, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than fifteen years. Article 3: Sabotage Any person who carries out an act to destruct any thing, substance or material that is used, or intended to be used, to the defense of the Empire of the Alexandrians, or to the maintenance of the internal security and public order therein, shall be guilty of a crime, called sabotage, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than fifteen years. Article 4: Subversion of His Imperial Majesty's Government Any person who, with the intention of causing violence or creating public disorder or public disturbance, says, writes, prints, utters or publishes any words : a. to bring His Imperial Majesty, the Imperial Parliament, the Cabinet, or any Law Court into such a dangerous degree of contempt that it be considered a threat to the public's best interests; b. to excite disaffection against His Imperial Majesty's Government to such a dangerous degree that it be considered a threat to the public's best interests; c. to excite the Citizens of this Empire of the Alexandrians to attempt to procure the alteration, otherwise than by lawful means, of any matter established by law of this Empire of the Alexandrians; d. to promote feelings of ill-will between different classes of the Citizens of the Empire of the Alexandrians so as to endanger the peace, order and good government of the Empire of the Alexandrians; e. to attempt to subvert the loyalty, morale, or discipline of the Imperial Military of the Empire of the Alexandrians; or f. counsels or advices any person to commit any of the aforesaid acts; shall be guilty of a crime, called subversion of His Imperial Majesty's Government, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than fifteen years. Article 5: Filibuster Any person who, with an intent prejudicial to the Sovereignty and Independence of the Empire of the Alexandrians, immigrates into, takes up residence in, or obtains or attempts to obtain Citizenship in the Empire of the Alexandrians, shall be guilty of a crime, called filibuster, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than ten years. Article 6: Espionage Any person who, with an intent prejudicial to the safety or defense of the Empire of the Alexandrians: a. makes within the territory of the Empire of the Alexandrians, a sketch, plan or photograph of a place or thing, or a note or document of a thing, that is likely to be, might be or is intended to be directly or indirectly useful to an enemy or a foreign nation; b. obtains, collects, records, uses, has in possession or communicates to another person any information, including an opinion or a report of a conversation, that is likely to be, might be or is intended to be useful to an enemy or a foreign nation; or c. approaches, is in, enters, inspects or passes over a place prohibited by Statute; shall be guilty of a crime, called espionage, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than ten years. Article 7: Usurpation Any person who usurps or unlawfully exercises any function of government, whether by setting up, maintaining or taking part in any way in a body of persons purporting to be a government or a legislature but not authorized in that behalf by or under the High Laws of Alexandria, or by setting up, maintaining, or taking part in any way in a purported Law Court or other tribunal not lawfully established, or by forming, maintaining, or being a member of an armed force or a purported police force not so authorized, or by any other action or conduct whatsoever, shall be guilty of a crime, called usurpation, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than fifteen years. Article 8: Obstruction of His Imperial Majesty's Government Any person who prevents or obstructs, or attempts or is concerned in an attempt to prevent or obstruct, by force of arms or other violent means or by any form of intimidation the carrying on of any branch (whether Legislative, Judicial, or Executive) of His Imperial Majesty's Government or the exercise or performance by any member of the legislature, the judiciary, or the executive or by any officer or employee (whether civil (including police) or military) of any of his functions, powers, or duties shall be guilty of a crime, called obstruction of His Imperial Majesty's Government, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than fifteen years. Article 9: Hindering of His Imperial Majesty Any person who prevents, or obstructs, or attempts or is concerned in an attempt to prevent or obstruct, by force of arms or other violent means or by any form of intimidation the exercise or performance by His Imperial Majesty of any of his functions, powers, or duties shall be guilty of a crime, called hindering of His Imperial Majesty, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than fifteen years. Chapter 2: Crimes Against Peaceful Relations with Foreign Nations Article 10: Aggression against a Foreign Nation A person who, being a Citizen of Alexandria or being lawfully present in the Empire of the Alexandrians, without order or approval of His Imperial Majesty, levies war, or does any act preparatory to levy war, against a Foreign Nation, with the exception of those involved in another Nation's military, shall be guilty of a crime, called aggression against a foreign nation, and liable to the punishment of expulsion for a period fixed by the Court of no less than six months. Article 11: Espionage in Prejudice of a Foreign Nation A person who, being a Citizen of Alexandria or being lawfully present in the Empire of the Alexandrians, commits, in favor of a foreign nation and in prejudice of another foreign nation any of the acts defined in the Chapter 1 Article 6, shall be guilty of a crime, called espionage in prejudice of a foreign nation, and liable to the punishment of expulsion for a period fixed by the Court of no less than six months or of suspension of civil rights for a period fixed by the Court of no less than six months. Chapter 3: Crimes Against the Administration of Justice Article 12: Definitions For the purposes of this Chapter: a. the word "Lord Justice" includes Judges of Law Courts other than the High Court or any other tribunal lawfully exercising judicial functions; b. the words "judicial proceeding" means a proceeding in or before the High Court, or any division thereof, or any other Law Court or tribunal lawfully exercising judicial functions. Article 13: Judicial Corruption A person who, being a Lord Justice, asks, receives, obtains, or agrees or attempts to receive or obtain, any benefit of any kind for himself or any other person, on account of anything already done or omitted to be done or to be afterwards done or omitted to be done by him in his judicial capacity shall be guilty of a crime, called judicial corruption, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than fifteen years. Article 14: Giving False Testimony A person who, in any judicial proceeding or for the purposes of instituting a judicial proceeding, knowingly gives false testimony touching any matter shall be guilty of a crime, called giving false testimony, and liable to the punishment of expulsion for a period fixed by the Court of no less than six months or of suspension of civil rights for a period fixed by the Court of no less than six months. Article 15: Corruption or Intimidation of Witnesses Any person who: a. threatens, intimidates, restrains, uses or causes the use of violence to or inflicts an injury on a person called or to be called as a witness in a judicial proceeding; or b. gives or offers to give a benefit of any kind to such a person in contreprestation to giving false testimony or withhold true testimony in a judicial proceeding; shall be guilty of a crime, called corruption or intimidation of witness, and liable to the punishment of expulsion for a period fixed by the Court of no less than ten months or of suspension of civil rights for a period fixed by the Court of no less than ten months. Article 16: Destroying Evidence A person who, knowing that a thing of any kind is or may be required in evidence in a judicial proceeding, willfully destroys or renders it illegible or incapable of identification, shall be guilty of a crime, called destroying evidence, and liable to the punishment of expulsion for a period fixed by the Court of no less than ten months or of suspension of civil rights for a period fixed by the Court of no less than ten months or of a forfeiture of no less than AE 50,000. Article 17: Contempt of Court A person who, during of or in relation to a judicial proceeding, says, writes, prints, utters or publishes any words to bring a Court any other tribunal lawfully exercising judicial functions into contempt, shall be guilty of a crime, called contempt of court, and liable to the punishment of expulsion for a period fixed by the Court of no less than two years or of suspension of civil rights for a period fixed by the Court of no less than two years. Article 18: Attempting to Pervert Justice Any person who attempts, in any way not specially defined in this Code, to obstruct, prevent, pervert, or defeat, the course of justice in relation to the judicial power of the Empire of the Alexandrians, shall be guilty of a crime, called attempting to pervert justice, and liable to the punishment of expulsion for a period fixed by the Court of no less than two years or of suspension of civil rights for a period fixed by the Court of no less than two years or of a forfeiture of no less than AE 50,000. Article 19: Escape Any person who is under suspension of civil rights or otherwise under the Law of the Empire of the Alexandrians restricted from posting in any forum of this Empire of the Alexandrians other than the Alexandrian Jail and the forums of the Courts of Alexandria until released in accordance with the Laws of the Empire of the Alexandrians who breaks his confinement, shall be guilty of a crime, called escape, and liable to the punishment of expulsion for a period fixed by the Court of no less than two years. Chapter 4: Crimes against Tranquility Article 20: Trolling Any person who posts rude, offensive, threatening, obscene, hostile or inflammatory messages on, from or via the forums of the Empire of the Alexandrians, shall be guilty of a crime, called trolling, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than ten years. Article 21: Flaming Any person who engages in an exchange of rude, offensive, threatening, obscene, hostile or inflammatory messages on, from or via the forums of the Empire of the Alexandrians, shall be guilty of a crime, called flaming, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than ten years. Article 22: Spamming Any person who with commercial or malicious intent, floods the forums of the Empire of the Alexandrians with unsolicited, unwanted, or unwelcome messages, or does the same from or via the forums of the Empire of the Alexandrians, shall be guilty of a crime, called spamming, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than ten years. Chapter 4: Crimes against the Economy Article 23: Forgery A person who makes or utters a false document representing any amount of the national currency units of the Empire of the Alexandrians shall be guilty of a crime, called forgery, and liable to the punishment of expulsion for a period fixed by the Court of no less than of no less than two years or of suspension of civil rights for a period fixed by the Court of no less than two years. Article 24: Stealing National Property A person who fraudulently takes any thing of any kind, including money, from the possession of the Empire of the Alexandrians or any authority of the government of the Empire of the Alexandrians or any legal person that is created by a statute or Imperial Instrument, shall be guilty of a crime, called stealing national property, and liable to the punishment of expulsion for a period fixed by the Court of no less than two years or of suspension of civil rights for a period fixed by the Court of no less than two years. Article 25: Exploitation Any person who: a. exploits the flaws of any banking system used by this Empire of the Alexandrians; b. exploits the labor of minors, those deemed unable to make an informed decision themselves or those at danger of physical violence; or c. in any other immoral fashion exploits anything else; For the sole purpose of gaining money, shall be guilty of a crime, called exploitation, and liable to the punishment of expulsion for a period fixed by the Court of no less than two years or of suspension of civil rights for a period fixed by the Court of no less than two years. Chapter 5: Crimes Against Different Persons Article 26: Defamation Any person who says, writes, prints, utters or publishes any untruthful words that cause someone to be shamed, ridiculed, held in contempt, lowered in the estimation of the community, or otherwise suffer a damaged reputation, shall be guilty of a crime, called defamation, and liable to the punishment of expulsion for a period fixed by the Court of no less than two years or of suspension of civil rights for a period fixed by the Court of no less than two years. Article 27: Using Another's Name A person who, uses the name of another person with the intent of causing deception or defamation of character, shall be guilty of a crime, called using another’s name, and liable to the punishment of exclusion or of expulsion for a period fixed by the Court of no less than six years. Article 28: Using False Identity A person who, in order to cause a mistake of another person, uses a name, or declares to have a character, that is not his own, shall be guilty of a crime, called using false identity, and liable to the punishment of expulsion for a period fixed by the Court of no less than two years or of suspension of civil rights for a period fixed by the Court of no less than two years or of forfeiture of AE 50,000. Article 29: Theft A person who takes into his possession any thing of any kind, including money, that belongs to another person, unless such an act is made in execution of a law or a contract, shall be guilty of a crime, called theft, and liable to the punishment of expulsion for a period fixed by the Court of no less than two years or of suspension of civil rights for a period fixed by the Court of no less than two years. Article 30: Fraud A person who commits the act defined in the precedent section in taking a thing that is entrusted to him by another person shall be guilty of a crime, called fraud, and liable to the punishment of expulsion for a period fixed by the Court of no less than two years or of suspension of civil rights for a period fixed by the Court of no less than two years. Article 31: Harassment Any person who systematically or continuously makes threatening, abusive or other vexatious comments towards an individual or behaves himself in such a fashion towards an individual on, from or via the forums of the Empire of the Alexandrians that is known or ought reasonably be known to be unwelcome that causes substantial emotional distress in such individual and serves no legitimate purpose, shall be guilty of a crime, called harassment, and liable to the punishment of expulsion for a period fixed by the Court of no less than ten years. Chapter 4: Hate Crimes Article 32: Hateful Harassment Any person who, by force or threat of force, willfully injures, intimidates, interferes with, oppresses, or threatens any other person in the free exercise or enjoyment of any right or privilege secured to him or her or by the Laws of the Empire of the Alexandrians because of the other person's race, color, religion, ancestry, national origin, disability, gender, or sexual orientation, or because he or she perceives that the other person has one or more of those characteristics, shall be guilty of a crime, called hateful harassment, and liable to the punishment of expulsion for a period fixed by the Court of no less than ten years. Article 33: Hateful Malicious Mischief Any person who knowingly defaces, damages, or destroys the real or personal property of any other person for the purpose of intimidating or interfering with the free exercise or enjoyment of any right or privilege secured to the other person by the Laws of the Empire of the Alexandrians, because of the other person's race, color, religion, ancestry, national origin, disability, gender, or sexual orientation, or because he or she perceives that the other person has one or more of those characteristics shall be guilty of a crime, called hateful malicious mischief, and liable to the punishment of expulsion for a period fixed by the Court of no less than ten years. Chapter 6: Conspiracy and Abetment Article 34: Conspiracy If two or more persons agree to commit any crime defined in this Code or any other Statute containing penal provisions, but the intended crime shall not be committed, each of these persons shall be guilty of a crime, called conspiracy, and liable to the same punishment that is prescribed by this Code or any other Statute containing penal provisions for the crime they have agreed to commit. Article 35: Abetment Any person who shall attempt to do any thing the doing of which is a crime under this Code, or any other Statute containing penal provisions, or who aids or abets or conspires with another person to do or attempt to do any such thing or advocates or encourages the doing of any such thing shall be guilty of a crime, called abetment, and liable to the same punishment that is prescribed by this Code, or any other Statute containing penal provisions, for the crime they have agreed to commit. Part II: Punishments Article 36: Exclusion (1) The effect of a sentence of exclusion shall be that the Defendant sentenced thereto shall be banned for life from the Empire of the Alexandrians and the Courts of Alexandria. (2) If the Defendant is a Citizen of Alexandria the effect of a sentence of exclusion shall also be that the Defendant shall cease to be a Citizen of Alexandria. (3) If the Defendant is a holder of any Titles and Honors granted by the Empire of the Alexandrians the effect of a sentence of exclusion shall also be that the Defendant shall cease to be a Citizen of Alexandria. (4) If the Defendant is a holder of any office or trust under the Empire of the Alexandrians the effect of a sentence of exclusion shall also be that the Defendant shall cease to hold any office or trust he holds under the Empire of the Alexandrians. (5) No pardon shall ever be granted to a person who is sentenced to exclusion. Article 37: Expulsion (1) The effect of a sentence of expulsion shall be that the Defendant sentenced thereto shall be banned from the Empire of the Alexandrians. (2) The punishment of expulsion may be imposed for a specified time. (3) The punishment of expulsion may be imposed for life. (4) If the Defendant is a Citizen of Alexandria the Court may also revoke the Alexandrian Citizenship of the Defendant. (5) If the Defendant is a holder of any Titles and Honors granted by the Empire of the Alexandrians the Law Court may also revoke the said Titles and Honors. (6) If the Defendant is a holder of any office or trust under this Empire of the Alexandrians the Court may also remove the Defendant from any office or trust he holds under the Empire of the Alexandrians. Article 38: Suspension of Civil Rights (1) The effect of a suspension of civil rights shall be that the Defendant sentenced thereto shall be restricted only to the Alexandrian Jail for a specified time. (2) If the Defendant is a Citizen of Alexandria the Court may also revoke the Alexandrian Citizenship of the Defendant. (3) If the Defendant is a holder of any Titles and Honors granted by the Empire of the Alexandrians the Court may also revoke the said Titles and Honors. (4) If the Defendant is a holder of any office or trust under the Empire of the Alexandrians the Court may also remove the Defendant from any office or trust he holds under the Empire of the Alexandrians. (5) During confinement to the Alexandrian Jail, the Defendant shall not post in any other forum of the Empire of the Alexandrians, other than the courts for any appropriate purpose therein, or the Alexandrian Jail forum. (6) If Defendant should post in a forum of the Empire of the Alexandrians other than the Courts or the jail, he shall be warned once; following that, the Court shall order the Defendant banned from the Empire of the Alexandrians for a period comprising the balance of his sentence. In addition, he shall be banned for a period of seven (7) days in addition for breaking his confinement. Article 39: Forfeiture (1) The effect of a sentence of forfeiture shall be that the person sentenced thereto shall be bound to pay to his Empire of the Alexandrians such amount of money as the Court fixes. (2) If the Defendant is a Citizen of Alexandria the Law Court may also revoke the Alexandrian Citizenship of the Defendant. (3) If the Defendant is a holder of any Titles and Honors granted by the Empire of the Alexandrians the Court may also revoke the said Titles and Honors. (4) If the Defendant is a holder of any office or trust under this Empire of the Alexandrians the Court may also remove the Defendant from any office or trust he holds under the Empire of the Alexandrians. Part 3: Final Provisions Article 40: Act to be General Criminal Code This Act shall be the General Criminal Code of Alexandria. Article 41: Repeal of Alexandrian Criminal Code The Alexandrian Criminal Code is hereby repealed. Article 42: Short Title This Act may be cited as the Imperial Criminal Code. Article 44: Commencement of Act This Act shall come into operation immediately after it has received Imperial Assent. |
